A Member of the Red Shirts Released from Jail

Sombat Thongyoi, 54, who is a former guard for Thailand’s anti-government United Front for Democracy against Dictatorship (UDD), known as the “Red Shirts”, was granted bail last week for his lèse-majesté charges. Previously he was sentenced to six years in prison without suspension for lèse majesté and computer crimes, for posting one of the King’s remarks in late 2020 and other comments about His Majesty on Facebook. A bail application was submitted. The Bangkok South Criminal court ruled that Sombat’s actions, in which he quoted a statement from King Vajiralongkorn, was deemed to be mockery and an insult.

Sombat’s other two Facebook posts, which commented on the King’s physical greetings to his supporters, have also been ruled by the court to be false and defamatory to the monarch. The Thai Lawyers for Human Rights (TLHR) earlier confirmed that a bail bond of 300,000 baht has been posted for his release of the 53-year-old activist, as the case was advance to the Appeals Court, pending the court’s approval. สมบัติ ทองย้อย ได้รับอิสรภาพชั่วคราว

ศาลอุทธรณ์ได้มีคำสั่งอนุญาตปล่อยชั่วคราว ‘สมบัติ ทองย้อย’ อดีตการ์ดเสื้อแดง วงเงินประกัน 70,000 บาท คดีโพสต์ภาพและข้อความดูหมิ่น ‘พล.อ.ประยุทธ์’ นายกฤษฎางค์ นุตจรัส ทนายความศูนย์ทนายความเพื่อสิทธิมนุษยชน เปิดเผยว่า หลังศาลฎีกามีคำสั่งอนุญาตปล่อยชั่วคราว นายสมบัติ ทองย้อย อดีตการ์ดเสื้อแดง ในคดี 112 เมื่อวันที่ 8 ก.พ.ที่ผ่านมา ทางทีมทนายความจึงได้ยื่นอุทธรณ์ในคดีดูหมิ่น พล.อ.ประยุทธ์ จันทร์โอชา นายกรัฐมนตรีและรมว.กลาโหม ซึ่งศาลอุทธรณ์ได้มีคำสั่งอนุญาตปล่อยชั่วคราววงเงินประกัน 70,000 บาท

และเมื่อวันที่ 9 ก.พ. 2566 ศาลนัดฟังคำสั่งในคำร้องขอปล่อยชั่วคราวในคดีหมายเลขคดีดำที่ อ1574/2564 หมายเลขคดีแดงที่ อ148/2566 ที่พนักงานอัยการยื่นฟ้อง นายสมบัติ ทองย้อย อดีตการ์ดเสื้อแดง คดีโพสต์ภาพและข้อความในเฟซบุ๊กมีเนื้อหาดูหมิ่น พล.อ.ประยุทธ์ จันทร์โอชา ในฐานะเจ้าพนักงาน จำนวน 2 โพสต์ (ในช่วงเดือน มิ.ย. 2562 และ ส.ค. 2563) คดีนี้ศาลอาญากรุงเทพใต้พิพากษาเมื่อวันที่ 31 ม.ค. 2566 จำคุก 1 ปี 1 เดือน ก่อนลดเหลือ 8 เดือน 20 วัน โดยจำเลยยื่นคำร้องขอปล่อยชั่วคราวระหว่างอุทธรณ์ ซึ่งที่ผ่านมาศาลเคยยกคำร้อง และศาลอุทธรณ์ได้มีคำสั่งอนุญาตปล่อยชั่วคราว วงเงินประกัน 70,000 บาท โดยนายสมบัติได้ออกจากเรือนจำช่วงเย็นวันที่ 9 ก.พ.ที่ผ่านมา รายละเอียดเพิ่มเติมที่ https://workpointtoday.com/news-274/.
